Applying for Automatic Mutual Recognition (AMR) in Tasmania

Guide for InvestorKit agents on applying for Automatic Mutual Recognition (AMR) or Queensland licence to work in Tasmania.

1. Purpose

This SOP outlines how InvestorKit property agents who are licensed in another Australian state or territory can notify the Property Agents Board of Tasmania (the Board) of their intention to undertake regulated property activities in Tasmania, using the Automatic Mutual Recognition (AMR) framework.

AMR allows licensed professionals to work across state and territory borders without needing to obtain a separate Tasmanian licence, provided eligibility requirements are met and proper notification is given before commencing any activity.


2. Eligibility Requirements

Before submitting a Notice of Intention, confirm all of the following apply to you:

  • You hold a current and valid property agent licence or registration in your home state or territory.
  • Your home state licence covers the activity you intend to undertake in Tasmania.
  • Your employer (InvestorKit) is licensed in Tasmania. The Notice of Intention cannot be processed unless the employing entity holds a Tasmanian licence.
  • You can truthfully sign all declarations on the form (no disciplinary proceedings, no cancelled licences, no relevant criminal convictions, not bankrupt).

Home State Definition Your 'home state' is either your principal place of residence or your principal place of business. If these are in different states, you may choose either one. Most InvestorKit agents will nominate New South Wales as their home state. Note: Queensland is not currently listed as an eligible AMR home state on this form. If your licence is Queensland-based, contact the Board before proceeding.


3. Supporting Documents to Prepare

Gather the following before you begin filling out the form. You will need to attach these when you submit.

Must show your current residential address. A passport or other government-issued photo ID showing your current address may be accepted if you do not hold a driver's licence.

Must be current (not expired). If you hold multiple relevant licences (e.g. Sales Agent + Property Manager), include a copy of each one you intend to rely on.

If your licence has any conditions attached, you must disclose all of them on the form. Incomplete disclosure means the Notice is invalid and you cannot lawfully commence activities in Tasmania.

4. How to Fill Out the AMR Notice of Intention Form

The form is three pages and has four main sections. Here is a step-by-step guide to completing each one accurately.

4.1 Contact Details (Page 1)

Complete all personal contact fields. Use your legal name as it appears on your licence and driver's licence. Fields to complete:

  • Surname, title, given name, and any other names
  • Date of birth
  • Current residential address (must match your driver's licence)
  • Telephone and mobile number
  • Personal and work email address

4.2 Home State Selection (Page 1)

Tick the box for the state or territory where your licence is held. For most InvestorKit agents, this will be New South Wales.

Reminder You can only nominate a state that is listed on the form. Eligible states are: Victoria, New South Wales, Northern Territory, South Australia, Australian Capital Territory, and Western Australia.

If your licence is held in Queensland or another unlisted state, please refer to point 6 below.

4.3 Licence/Registration Details (Page 1)

List each relevant licence or registration you hold in your home state. For each one, record:

  • Licence type (e.g. Real Estate Agent, Buyers Agent, Property Manager)
  • Licence/registration number (as shown on your licence certificate)
  • State
  • Expiry date

Then, in the conditions section directly below, disclose any conditions or restrictions attached to each licence. If your licence has no conditions, leave this section blank. Do not skip it without checking your licence certificate.

Critical If any conditions on your licence are not disclosed, the Notice of Intention is considered incomplete and you cannot legally commence activities in Tasmania. When in doubt, include it.

4.4 Employment Details (Page 2)

💡 Note on Employer Licensing The form requires your employer to be licensed in Tasmania. If you are unsure whether InvestorKit holds a current Tasmanian licence at the time of your application, check with the Operations team before submitting.

4.5 Declaration (Pages 2–3)

Read each declaration carefully and tick Yes or No for each one. You are expected to tick Yes to all declarations. Ticking No to any declaration does not automatically disqualify you, but you must provide a written explanation with the form.

The declarations cover the following:

  • You will only undertake activities in Tasmania that your home state licence covers
  • You are not subject to any disciplinary proceedings in any state or territory
  • No licence you hold or held has been cancelled or suspended through disciplinary action
  • You are not personally prohibited from carrying on the activity due to criminal, civil, or disciplinary proceedings
  • You have not been convicted of or found guilty of any offences (excluding traffic offences), nor do you have pending criminal charges
  • You are not an undischarged bankrupt or subject to any insolvency arrangement
  • All information and documents provided are true and correct
  • You consent to information sharing between the Board and licensing authorities in other states
  • You understand and will comply with all applicable Tasmanian legislation and the Board's Code of Conduct
  • You will complete Continuing Professional Development (CPD) as required by the Board
  • You will notify the Board of any changes to your name, address, contact details, or circumstances that affect these declarations

Sign and date the form once you have completed and reviewed all sections.

4.6 How to Submit (AMR — All Other States)

Once the form is fully completed and signed, and all supporting documents are ready, submit via one of the following methods:

5. Continuing Professional Development (CPD)

The TAS Property Agents Board has confirmed that CPD completed in your home state can generally be mutually recognised. You do not need to complete separate Tasmanian CPD in most cases.

If any additional training is required beyond what you have completed in your home state, the Board will contact us directly to advise. No action is needed on your part unless you hear otherwise.


6. Queensland-Licensed Agents: TAS Mutual Recognition Licence Application

Queensland is not listed as an eligible home state on the AMR Notice of Intention form. If your licence is held in Queensland, you cannot use the AMR pathway and must instead apply for a formal Tasmanian licence via the Registration of Equivalent Occupation process under the Mutual Recognition Act 1992.

Note: Queensland equivalents should confirm their licence category with the Board if unsure which type to apply for.

6.3 Additional Supporting Documents Required

This application has more document requirements than the AMR pathway.

Must be a certified copy (not original). Certified by a JP, Commissioner for Declarations, Barrister/Solicitor, or Notary Public. Must show your photo and current residential address. If your photo ID does not include your address, you can supplement with a utility bill, council rates notice, or bank statement.

Must be issued no more than 3 months before lodgement. Purpose category: "general employment". As an interstate applicant, obtain this from Queensland Police Service (not Tasmania Police).

Must be issued no more than 7 days before lodgement. Obtain from the Australian Financial Security Authority (AFSA) website.

6.4 Filling Out the Form

Licence Type Selection Tick the licence type that corresponds to your Queensland licence (e.g. if you hold a Real Estate Agent licence in QLD, tick Real Estate Agent).

Your Details Complete all personal details using your legal name as it appears on your licence. Include any previous names and reason for change if applicable. You will also need your driver's licence number and/or passport number.

Licence/Registration Details List your current Queensland licence(s). Include the state, licence type, licence number, issue date, and expiry date for each. Attach certified copies of each licence.

Employment Questions (Page 2) Answer the three employment questions. For most InvestorKit agents, Question 2 (seeking a licence to work for an agency) will be Yes. Complete the Employment Details section using the following InvestorKit details:

⚠️ Employer Signature Required Unlike the AMR form, this form requires your employer to sign and confirm your employment. The nominated managing agent at InvestorKit will need to sign the employer section before you submit. Contact the Operations team to arrange this.

Disclosure Questions (Page 3) Answer all seven disclosure questions honestly. If you answer Yes to any question, you must provide a written explanation. Answering Yes does not automatically disqualify you but the Board will consider the circumstances.

Declaration (Page 3) Complete the statutory declaration with your full name, address, signature, and date. You will also need a witness to sign. Eligible witnesses include a Justice of the Peace, solicitor, medical practitioner, police officer, or teacher. A full list is on pages 3-4 of the form notes.

6.5 Processing Time

Allow up to 10 business days for application review, plus a further 10 business days for assessment and licence grant. This is longer than the AMR pathway, so plan ahead before commencing activities in Tasmania.

🚨 Important You cannot commence regulated activities in Tasmania until the licence is granted. Unlike AMR, submitting the application does not give you the right to start working.

8. Important Reminders

🚨

Before You Start Working in Tasmania You must submit your Notice of Intention and receive confirmation from the Board before commencing any regulated activity in Tasmania. Do not assume submission alone is sufficient.

If you change your name, residential address, contact details, or if anything changes that would affect your declarations, you must notify the Board as soon as practicable.

Keep copies of everything you submit. Store your completed form and all supporting documents in your personnel file and notify the Operations team once submission is confirmed.
